HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.1196 OF 2017 ORDER:

This Criminal Petition is filed under Sections 438 of Cr.P.C. to enlarge the petitioner on bail in Crime No.5 of 2017 of II Town Police Station, Hindupur, Ananthapuramu District, in the event of his arrest, registered for the alleged offences punishable under Sections 354, 506 and 509 of I.P.C. and Section 3(x) (1) of Scheduled Castes and Scheduled Tribes (POA) Act, 1989, apprehending arrest in the above crime.

While commencing argument of learned counsel for the petitioner, Public Prosecutor for the State of Andhra Pradesh represented that a notice under Section 41-A was issued and pursuant to it, petitioner appeared before the police and he was released on bail and he is continuously appearing if directed by police and co-operating the police for completion of investigation. Therefore, no pre-arrest bail need to be granted when the police released the petitioner on bail.

Hence, this Criminal Petition is dismissed as infructuous. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. _________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 21-2-2017.
