THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.9281 of 2013 Order:

This Writ Petition is filed to declare the action of the respondents in not considering the representations submitted by the petitioners for inclusion of Gudikal village into Yemmiganur Municipality as illegal and arbitrary and a consequential direction was sought to take action on the representations submitted by the petitioners as per the rules framed in G.O.Ms.No.63, Municipal Administration and Urban Development (Elec.II) Department, dated 18.02.2006.

The case of the petitioners is that they are the residents of Gudikal village of Yemmiganur Mandal and that the said village is just 1⁄2 KM from Yemmiganur Municipality; they made a representation to the respondents for inclusion of Gudikal village in Yemmiganur Municipality under the relevant rules of G.O.Ms.No.63, Municipal Administration and Urban Development (Elec.II) Department, dated 18.02.2006, and that there is no justification for not including the Gudikal village in Yemmiganur Municipality.

Counter affidavit has been filed by the fourth respondent admitting the receipt of the representation of the petitioners dated 16.08.2012 and denying the other contentions in the writ petition. It is stated that only very few people filed a representation seeking inclusion of the said village into the Municipality and that the public at large are not interested in the same.

At this stage, learned counsel for the petitioners submits that the respondents may be directed to follow the procedure as contemplated under G.O.Ms.No.63, Municipal Administration and Urban Development (Elec.II) Department, dated 18.02.2006.

Having regard to the facts and circumstances of the case, the respondents are directed to consider the representation of the petitioners in accordance with G.O.Ms.No.63, Municipal Administration and Urban Development (Elec.II) Department, dated 18.02.2006, and take appropriate action in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
