This criminal petition is filed by the petitioners/ A.1 & A.2 under Section 438 of Cr.P.C., to direct the Station House Officer, Sanjeeva Reddy Nagar PS, Hyderabad, to enlarge them on bail in the event of their arrest in connection with Cr.No.67 of 2017, registered for the offences punishable under Sections 420, 402, 506 read with 34of IPC.

2. The case of the petitioners is that they entered into an agreement of sale and settlement deed with the complainant and that there are certain terms and conditions for repayment of the amount. At this stage, it is not proper to consider whether the petitioners repaid the amount or not. However, learned Additional Public Prosecutor (TS) represented that a notice under Section 41-A of Cr.P.C. was issued but the petitioners did not respond to the said notice.

3. Taking into consideration of the nature of the offences, I find that this is a fit case to direct the Station House Officer to follow the guidelines issued by the Supreme Court in ' Arnesh Kumar vs. St at e of Bihar & anot her 1'.
