THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10283 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 to 3 seeking bail in the event of their arrest in connection with Crime.No.1122 of 2023 on the file of Meerpet Police Station, Rachakonda, registered for the offences under Sections 120b, 406, 420, 467 and 468 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant lodged a private complaint alleging that the petitioners are distant relatives.

The complainant agreed to purchase the property of A-1 for total consideration of Rs.70,00,000/- and paid Rs.20,00,000/-. There was a bank loan in respect of the said property. The possession of the house was handed over to the complainant. However, on 19.01.2023, the complainant came to know that the said property was sold to someone else.

Having lodged a complaint with the Police on 29.04.2023, since informed that the disputes are civil in nature, a private complaint was filed on 27.06.2023.

Since all the transactions in the present complaint are in respect of the property that was sold by A-1 and also the documents are available with the Bank and SRO, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.1 to 3 are directed to surrender before the Station House Officer, Meerpet Police Station, Rachakonda, on or before 27.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.1 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required. As far as petitioners/Accused Nos.2 and 3 are concerned, they shall appear as and when required.

3) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
