HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.450 of 2014 ORDER:

This petition is filed to withdraw O.P.No.43 of 2014 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Family Court, Vijayawada for disposal in accordance with law.

2. Petitioner herein is respondent in O.P No.43 of 2014 and respondent herein filed the said O.P for maintenance.

3. The main contention of petitioner herein is that he is a senior citizen and suffering with some old age ailments and is not able to move and he cannot travel covering a distance of 350 KMs from Vijayawada to Ranga Reddy District for the purpose of defending O.P.No.43 of 2014 filed by respondent herein.

4. Other side filed counter opposing transfer and contended that respondent is a lady and she has got two small children to look after and it is inconvenient for her, if the case is transferred from Ranga Reddy to Vijayawada.

5. Heard both sides.

6. Both side advocates submitted their argument supporting the contentions of their respective clients. Considering the contentions and rival contentions of both parties and also considering the age of petitioner herein, this Transfer Civil Miscellaneous Petition is disposed of directing the Family Court, Ranga Reddy to decide O.P No.43 of 2014 within six (06) months from the date of receipt of this order by dispensing with the presence of petitioner herein for each and every adjournment. However, he shall appear as and when his physical presence is necessary for any specific purpose.

7. Accordingly, the Transfer Miscellaneous Petition is disposed of. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. ___________________ S. RAVI KUMAR, J Date: 23.04.2015.
