THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11482 of 2025 ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1 and 2 in Crime No.165 of 2025 before the Huzurnagar Police Station, Suryapet District, registered for the offence punishable under Sections 126(2), 115(2), 118(1)(2) read with 3(5) of BNS.

The case of the prosecution is that the defacto complainant alleged that on August 12, 2025, at around 8:00 pm, her husband, Sanjeeva Reddy, was returning from their agriculture lands when the petitioners, allegedly obstructed his motor vehicle due to previous land grudges, beat him with their hands, and forcibly took his mobile phone. The assault left Sanjeeva Reddy unconscious with bleeding injuries on his face. After some time, Sanjeeva Reddy managed to make a phone call using a stranger's mobile phone, and the complainant rushed to the scene, finding her husband lying down with injuries. He was immediately shifted to the hospital for treatment, and the complainant lodged
a petition seeking necessary legal action against the accused persons. Aggrieved thereby, this Criminal Petition is filed. 3.
Heard Sri P.Ramulu, learned counsel for petitioners, and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for respondent - State.

Learned counsel for petitioners submitted that the petitioners are innocent and have been falsely implicated in the case due to a land dispute with the defacto complainant, with allegations being false, exaggerated, and implausible. He contended that the police, under political pressure, converted a petty incident into a serious case without ingredients of the alleged offenses being made out. He further contended that it was the husband of complainant who attacked petitioner No.2, due to which he sustained injuries and received treatment, but the police ignored their version and refused to register their complaint. He lamented that despite representations to higher authorities, including the DGP, no action has been taken, establishing mala fide intention.
While advocating that petitioners face a serious life threat from the defacto complainant and his associates, having been physically attacked in the past,
he prayed this Court to allow the Criminal Petition by granting the relief of anticipatory bail to petitioners. 5.
On the other hand, the learned Additional Public Prosecutor, vehemently opposed the submissions made by learned counsel for petitioners and submitted that the allegations leveled against the petitioners are of serious nature. Therefore, while advocating that the investigation is still pending, he prayed this Court to dismiss the Criminal Petition.

Having regard to the rival submissions made, on going through the material placed on record, it is seen that there were previous disputes between the parties and the petitioners specifically contend that it was the petitioner No.2 who was attacked in the hands of husband of complainant. In support of the said contention, the petitioners have filed medical reports as well. Therefore, considering the peculiar facts and circumstances of this case, this Court deems it fit to grant pre-arrest bail to petitioners, subject to compliance of the following conditions: i.
The petitioners shall surrender before the Station House Officer, Huzurnagar Police Station, Suryapet District, within two weeks from today, and on such surrender,
the said Station House Officer shall release them on bail, on them executing a personal bond for Rs.25,000/- each, (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
