THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11035 OF 2016 O R D E R :

Petitioner had presented a sale deed dt.07.04.2015 before the respondents for the purpose of registration, but petitioner contends that the 3rd respondent had orally refused to register the said document on the ground that Pattadar Passbook and Title Deeds were not produced by the petitioner.

Counsel for the petitioner has placed before me Memo No.G1/1249/2012 dt.29.01.2014 issued by the Commissioner and Inspector General of Registration and Stamps, A.P., Hyderabad, addressed to all the District Registrars and Deputy Inspector General of Registration and Stamp in the State, stating that there is no need to produce Pattadar Passbooks and Title Deeds where Civil Courts have issued a decree or order to execute a sale deed in Execution Petition to judgment debtor relating to agricultural lands.

3. Petitioner contends that a sale deed was executed in his favour pursuant to a decree passed in O.S.No.254 of 2003 on the file of I Additional Senior Civil Judge, Rajaymundry and therefore the said memo should be considered by the 3rd respondent.

4. Therefore, the Writ Petition is allowed directing the 3rd respondent to receive the document presented by the petitioner and consider the same for the purpose of registration in the light of the above Memo dt.29.01.2014; and if he does not wish to register the document, he shall pass a reasoned order under Section 71 of the Act giving reasons why he does not wish to register the said document within a period of three (03) weeks from the date of submission of the said document by the petitioner. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
