It is the case of the petitioners that the erstwhile Government of Andhra Pradesh vide G.O.Ms.No.425, dated 25.03.2008 allotted land to an extent of Acs.22.14 gts in Sy.No.37 and Acs.7.26 gts in Sy.No.34 of Gopanpally Village, Srilingampally Mandal, Ranga Reddy District to the 1st petitioner society. In pursuant to the allotment and in furtherance of the payment of the consideration amount by the 1st petitioner's members, a registered Conveyance Deed was executed in favour of the 1st petitioner society by the erstwhile Government of Andhra Pradesh on 02.04.2008 and possession was handed over to the 1st petitioner on the same day. While so, the Government of A.P had issued G.O.Ms.No.1252 dated 08.12.2009 purporting to alienate an extent of Acs.3.34 gts in Sy.No.37 to the 4th respondent for development of 45 meters wide road.
Aggrieved by the said G.O, the 1st petitioner's society filed W.P.No.23098 of 2011. When the matter came up for hearing, a representation was made on behalf of the learned Advocate General across the Bar stating that the alternative land in Sy.No.34 of Gopanpalli Village, admeasuring Acs.3.34 guntas was allotted to the petitioners and the same has been duly identified and demarcated.
petitioners. In spite of the said undertaking, the land to an extent of Acs.3.34 guntas in Sy.No.34 was not handed over to the petitioners. Aggrieved by the same, the present writ petition is filed.
Heard Sri D.Prakash Reddy, learned Senior Counsel for the petitioners and learned Additional Advocate General on behalf of the respondents 1 to 3, Sri Y.Rama Rao, learned Standing Counsel for the 4th respondent and Sri Y.Sampath Prabhakar Reddy, learned Standing Counsel for the 5th respondent. Learned Additional Advocate General submits that the Government is prepared to allot land to an extent of Acs.3.34 guntas in Sy.No.34 of Gopanpally Village to the petitioner, as per the statement in W.P.No.23098 of 2011.
Recording the submission of the learned Additional Advocate General, the 1st respondent is to take necessary steps for handing over the possession of allotted land i.e., Acs.3.34 guntas in Sy.No.34 of Gopanpally Village, to the 1st petitioner society within a period of two months from the date of receipt of a copy of this order. In view of the same, the interim order dated 28.11.2014 shall stand vacated.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stands closed.
