THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8322 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/A1 & A2 in connection with Crime No.18 of 2022 on the file of Warangal Railway Police Station, Secunderabad Railway Police District, for the offences punishable under Section 8c read with 20(b) of NDPS Act. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Warangal Railway Police apprehended these petitioners for being in possession of 28 Kgs and 24 Kgs of Dry Ganja, respectively. The Police completed investigation and filed charge sheet on 15.07.2022.

Learned Counsel for the petitioners submits that investigation is complete and nothing remains and further these petitioners are the sole earning members of their families and prayed to enlarge these petitioners on bail.

Learned Assistant Public Prosecutor submits that there are no other criminal antecedents against these petitioners.

In the said circumstances, these petitioners are directed to be released on bail on the following conditions: i) The petitioners/A1 & A2 shall execute personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to the satisfaction of Judicial First class Magistrate for Railways at Kazipet.

(ii) The petitioners/A1 & A2 shall appear before the concerned Court on every date of hearing, failing which the bail shall stand cancelled.

iii) The petitioners/A1 & A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
