Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.39 of Walegaon Village, Bhainsa Mandal, Adilabad District. While so, on 05.08.2015, the Deputy Tahsildar (Enforcement) has inspected the shop of the petitioner and noticed some variations. In respect of the said variations, 6-A proceedings were initiated and they are pending. Based on the report of the said officer dated 06.08.2015, the second respondent issued proceedings dated 14.08.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed.
3. The second respondent should have seen that 6-A proceedings are different from the proceedings before him and he should have conducted an independent enquiry in respect of the allegations leveled against the petitioner.
4. In the circumstances, the writ petition is disposed of directing the second respondent to conduct an enquiry in respect of the allegations leveled against the petitioner and complete the same, within a period of 90 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.
