HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition Nos.10880, 10897 and 10898 of 2008 COMMON ORDER:
The petitioners in these three writ petitions, seek a direction in the nature of writ of Mandamus declaring the action of the 2nd respondent in not disposing of the statutory appeals filed by them as against the orders passed by the 1st respondent in LTR Case No.2/VKP/2008 dated 01.03.2008 in respect of buildings in Sy.Nos.68/P, 75/P and 75/P in an extent of 0.04 cts., 0.021⁄2 cts. and 0.05cts. respectively situated in Venkatapuram village and Mandal, Khammam District as illegal and violative of Articles 14, 21 and 300(A) of the Constitution and consequently direct the 2nd respondent to dispose of the appeals.
2) As can be seen, in LTR Case No.2/VKP/2008 the writ petitioners appeared as 2nd, 4th and 5th respondents respectively and as per the order dated 01.03.2008, the 1st respondent passed decree of ejectment of respondents therein from the lands in Sy.Nos.68/P, 68/P, 39/1, 75/P, 75/P, 44 and 46 to an extent of 0.10 cts., 0.04 cts., 0.08 cts. 0.021⁄2 cts., 0.05 cts. 0.03 cts. and 0.06 cts. respectively situated at Venkatapuram village and Mandal and the property to be taken into Government custody for assigning the same to eligible tribals as per law in force.
3) Aggrieved by the said order, the petitioners filed appeals and their grievance is that though a decade has passed, the said appeals are not disposed of so far.
4) Considering the submission of learned counsel for petitioners, these writ petitions are disposed of with a direction to the 2nd respondent to dispose of the unnumbered LTR Appeal Nos._______ of 2008 preferred by the writ petitioners expeditiously not later than two (2) months from the date of receipt of copy of this order, if the said appeals are not already disposed of. No costs.
