THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.13420 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"To issue a writ or order or direction more particularly in the nature of Writ of Mandamus, to declaring the paper notification dated 12.9.2015 issued by the 3rd respondent in conducting recruitment for the post of Anganwadi worker in Atmakur Anganwadi Centre, Kurnool District as arbitrary, illegal and violation of Article 14, 16, 21 of the Constitution of India and also contrary to memo No. 9207/ICDSA1/98 dated 23.12.1998, Memo No. 5771/KG/2006 dated 3.12.2010, Memo No. 5771/K3/2006, dated 5.1.2012 issued by the respondents 1 &, 2 and further declare that the petitioner is entitled to be appointed as Anganwadi worker and consequently direct the respondents to appoint/promote the petitioner as Anganwadi Worker in respect of Atmakur Anganwadi centre in the interest of justice."

Today, when the matter is called, it is represented by the learned counsel for the petitioner as well as the learned Government Pleader that the issue in the present writ petition is squarely covered by the common order passed by this Court in W.P.Nos.40504 and 40505 of 2015 dated 15.12.2015 and a copy of the same is placed on record by the learned Counsel.

3. Having regard to the earlier judgment of this Court and following the same, the recruitment notification dated 12.9.2015 is set aside and respondents are directed to consider the claim of the petitioner for promotion/appointment as Anganwadi Worker in her village as per her eligibility and suitability within a period of four weeks from the date of receipt of this order.

4. Accordingly, the writ petition is allowed. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
