THE HONOURABLE SRI JUSTICE K.SURENDER WRIT PETITION No.33769 of 2021 ORDER:

This writ petition has been filed to issue a Writ, Order or direction more particularly in the nature of a Writ of Certiorari by calling for records relating to S.T.C.NI.No.314 of 2021 on the file of VI metropolitan Magistrate, Hyderabad at Manoranjan Complex and quash the same in so far as the petitioners are concerned and to pass such other order or orders.

Heard learned counsel for the petitioners and learned counsel for the 2nd respondent-defacto complainant. 3.

Several grounds are raised including the grounds of there being no legally enforceable debt and/or subsisting liability.

All these questions are mixed questions of fact and law which can only be agitated before the trial Court during trial. If the petitioners are so advised, they can file an application seeking discharge, in accordance with law.

With the above observations, the Writ Petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, shall stand closed.
