THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8342 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.125 of 2022 on the file of Kothakota Police Station, Wanaparthy District, for the offences punishable under Section 302, 201, read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the defacto complainant's husband namely Sridhar Reddy went missing. On complaint made by her the police investigated the case and found during their investigation that Accused No.1 with the help of Accused Nos.2 and 3 committed murder of the said Sridhar Reddy and thrown him in a river.

However, as seen from the Remand Report, the police collected information regarding disputes between them and also transfer of money interse between the Accused Nos.1 to 3. However, apart from the confession of accused, there are no other

circumstances reflected in the Remand report to conclude that these accused are responsible for the alleged death of Sridhar Reddy. Further, in the said circumstances, Accused No.3 was also granted bail by this court.

In the said circumstances, this petitioner who is Accused No.1 is granted bail subject to the following conditions. i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class, Atmakur.

(ii) The petitioner/A1 shall appear before the concerned Station House Officer, every day between 10.00 A.M. to 1.00 P.M. for a period of thirty days, for the purpose of investigation.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
