THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22372 OF 2017 ORDER:
This writ petition is filed seeking to issue a writ of mandamus to declare the action of respondents 2 and 3 in not restoring the drinking water supply connection to the petitioner's house bearing Municipal No.4-1-10, Bogulakunta, Hyderabad, after repeated representations and even after completing all the formalities, as illegal and arbitrary, and consequently, direct the respondents 2 and 3 to either restore the existing drinking water supply connection or to provide a new drinking water supply connection to the petitioner's house. It is the case of the petitioner that the drinking water supply connection to the petitioner's house bearing Municipal No.4-1-10, Bogulkunta, Hyderabad, was damaged due to road repair and since then the water supply connection to the petitioner's house was blocked.
When the petitioner approached the authorities concerned to restore the drinking water connection, they directed him to apply for a new water connection as the existing connection is not in his name. Therefore, the petitioner applied for new water supply connection on 28.07.2016, by paying the requisite fee. Thereafter, the petitioner submitted several representations to the 3rd respondent requesting to give new water supply connection. But, no action has been taken by the 3rd respondent. Hence, this writ petition.
Heard and perused the material available on record. Learned Standing Counsel appearing for the 3rd respondent submitted that the 3rd resident will consider the application of the petitioner and pass appropriate orders.
Considering the circumstances of the case and the grievance of the petitioner, and in view of the submission of the learned Standing Counsel, without expressing any opinion on merits, this Court is inclined to pass the following order:
The Writ Petition is disposed of directing the 3rd respondent to consider application, dated 28.07.2016, made by the petitioner and pass appropriate orders in accordance with law as expeditiously as possible. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
