HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7534 OF 2018 ORDER:

The petitioners are A2 to A5 among five accused in Crime No.96 of 2018 on the file of the Mavala Police Station, Adilabad Disttict. The crime is registered on 29.06.2018 for the offences punishable under Sections 498-A, 307 & 109 IPC. 2.

The sum and substance of the accusation from the statement of the father of victim as de facto complainant is that A1 is the husband of victim and A2 to A5 are the relatives of the husband, who are in abscondance, and there was ill-treatment and harassment and A1 poured the kerosene and set her ablaze and the victim lonely run over from the house from the clutches of the accused persons in saving her life by immediately rushed to the hospital. The hospital record shows she was admitted with burn injuries.

Heard the learned counsel for the petitioners and the learned Public Prosecutor representing the State of Telangana and perused the material on record.

A1 was arrested and A2 to A5 earlier moved for anticipatory bail and went unsuccessful in Crl.M.P.No.698 of 2018 by order dated 16.07.2018 passed by the learned Judge, Family Court-cum-IV Additional District & Sessions Judge, Adilabad. A perusal of the remand report, the bail application averments, F.I.R. and the case

Dr. SSRB,J Crl. P.No.7534 of 2018 diary shows even the petitioners does not deserve the concession of anticipatory bail.

Though it the submission of learned counsel for the petitionersA2 to A5 that the petitioners are residing at different places and there is no role of them, but the case diary clearly shows particularly from the remand report all are residents of the same place. Undisputedly, A2 to A5 are inmates and not even a case of they admitted in the hospital much less put off the fire in saving the victim even A1 set her ablaze by pouring kerosene that too in the house where all are residing together. Hence, the petitioners-A2 to A5 are not entitled to the concession of anticipatory bail.
