ORAL ORDER:

Heard learned counsel for petitioner, learned Government Pleader for Revenue (AP) and Sri T.Bala Mohan Reddy learned counsel for 5th respondent and with their consent the writ petition itself is taken up for final disposal. 2.

By order dated 9.10.2016 Tahsildar/3rd respondent passed orders holding purchase stated to have been made by petitioner from 5th unofficial respondent as illegal, void in view of the provisions of A.P. Assigned Lands (POT) Act, 1977, therefore directed eviction and resumption of the land. On appeal, the Revenue Divisional Officer/2nd respondent affirmed the decision of the Tahsildar. Aggrieved thereby, petitioner preferred Second Appeal along with an interlocutory stay application before the Collector/first respondent and the same is pending.

Learned counsel for petitioner submitted that pending interlocutory stay application and Second Appeal before the first respondent, 5th respondent is threatening to dispossess the petitioner and trying to take the standing crop. 4.

Having regard to the above facts, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the District Collector/first respondent to afford opportunity of hearing to the petitioner as well as 5th respondent and to dispose of the interlocutory stay application pending in the Second Appeal within a period of two weeks and to dispose of the pending Second Appeal within a period of 8 weeks from the date of receipt of copy of this order. Till the interlocutory stay application is decided by the first respondent, 5th respondent shall not interfere with the possession of the petitioner.
