Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The present Criminal Revision Case is filed questioning the orders passed in Crl.M.P.No.1097 of 2017 in C.C.No.1529 of 2015 dated 30.5.2018 on the file of the Court of Judicial Magistrate of First Class, Kurnool, in dismissing the petition filed under Section 245 (2) of Cr.P.C. to discharge the petitioner for the offence under Sections 420, 468 and 471 of IPC.

Learned counsel for the petitioner, having argued for some time, on the query raised by this Court, seeks permission of the Court to withdraw the Criminal Revision Case with liberty to move an appropriate application before the Court below. 4.
Acceding to the said request, Criminal Revision Case is dismissed as withdrawn giving liberty to the petitioner to move a fresh application for discharge under an appropriate provision of law, upon which, the learned magistrate is directed to consider the same and pass appropriate orders.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
