THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8344 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A4 in connection with Crime No.109 of 2022 on the file of LMD Colony Police Station, Karimnagar District District, for the offences punishable under Sections 143, 120, 120(b) read with 149 of Indian Penal Code and Section 4 of the Explosive Substances Act, 1908 and Sections 10, 13, 16 and 18 of the Un-lawful Activities Preventions Amendment Act, 2008/2019.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
The case against the petitioner is that he has taken Rs.3 lakhs from one CPI Maoist who is arrayed as Accused No.3 and handed over to Accused No.6 for the purchase of explosive material. In turn Accused No.6 has purchased material from different persons. While transporting the said material they were caught.

According to the prosecution this petitioner acted as mediator between the Maoists and Accused No.6 and the only allegation against this petitioner is that he handed over Rs.3 lakhs on the instructions of Accused No.3.

Learned Counsel for the petitioner submits that he was taken into police custody and also investigated.

In the said circumstances, this petitioner can be granted the relief of regular bail subject to the following conditions. i) The petitioner/A4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, among which one is local surety and another is native surety, to the satisfaction of Special Judicial First Class Magistrate (Excise), Karimnagar. (ii) The petitioner/A4 shall appear before the concerned Station House Officer, on every Monday, Wednesday and Friday between 10.00 A.M. to 1.00 P.M. for a period of six weeks, for the purpose of investigation.
iii) The petitioner/A4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
