Heard the learned counsel for the petitioners and the learned Standing counsel appearing for the 3rd respondent - Municipality. The prayer sought in the writ petition is as under: "... to issue an appropriate writ or order or direction more particularly a writ in the nature of writ of mandamus declaring the inaction of the 3rd respondent in not considering our representation dated 05.12.2019 against the illegal structure being set up a small scale industry by the 4th respondent herein in a residential zone without requisite permissions as is illegal, arbitrary and unconstitutional and consequently direct the 3rd respondent herein to consider the representation of the petitioner and initiate action against 4th respondent's illegal construction." Learned Standing counsel, on instructions, submits that the 3rd respondent - Municipality will consider the representation dated 05.12.2019 submitted by the petitioner and pass appropriate orders.
In the light of the above said submission made by the learned Standing counsel, the writ petition is disposed of, directing the 3rd respondent to consider the representation dated 05.12.2019 submitted by the petitioner and pass appropriate orders as per law within a period of three weeks from the date of receipt of a copy of this order.
