THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 5416 OF 2013 ORDER:

This Writ Petition is filed to declare the action of the respondents in not refunding the balance amount of Rs.40,38,718/- out of the total amount of Rs.1,36,46,575/- deposited by the petitioner towards lease amount for Reach Nos. 8 and 9 of Penumudi and Moorthota Villages respectively of Guntur District, in spite of the direction issued by respondent No. 1 in Memo dated 02-08-2010.

Counter affidavit has been filed by the Chief Executive Officer, Zilla Parishad, Guntur District-respondent No. 5 stating that he paid the balance amount of Rs.40,38,713/- to the petitioner by way of demand draft dated 21-03-2013 and that the latter has also issued a receipt on 02-04-2013 to the said effect. A copy of the receipt issued by the petitioner is also enclosed to the counter affidavit.

As the amount claimed by the petitioner has already been paid to him by respondent No. 5 and the same is acknowledged by the former, no further orders are necessary in the Writ Petition. 4.

The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
