HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 19036 of 2004 ORDER:

When this matter is taken up for hearing today, it is noticed that the petitioner is seeking absorption into aided services from the date of her initial appointment. The petitioner is also contending that on absorption she was placed on apprenticeship for a period of two years instead of granting regular pay scale.

This Court having considered the above said issue is of the view that the issue raised in this writ petition is squarely covered by the judgment rendered by the Hon'ble Division Bench of this Court in W.A.No.202 of 2012, dated 22.8.2013. Since the petitioner was absorbed into the aided services from unaided services, the question of placing the petitioner on apprenticeship for another two years from the date of approval would not arise in view of the laid down by the Hon'ble Division Bench in the above writ appeal.

Accordingly, the Writ Petition is disposed of directing the respondents to extend regular pay scale to the petitioner instead of placing her on apprenticeship for a period of two years, and further directing the respondents to regularize her services from the date of absorption into aided vacancy. No

costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
