THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.12721 OF 2006 ORDER:

This writ petition is filed seeking a direction to the respondents not to interfere with the peaceful possession and enjoyment of the petitioner in respect of his land in an extent of Ac.1-68 cents in Sy.No.201/4, situated at Prakasaraopalem village, Nallajarla Mandal, West Godavari District and further direct the respondents to return the construction material or to pay a sum of Rs.60,000/- towards damages to the petitioner by declaring the action of the respondents as highly unwarranted, unjust, violative of Articles 14, 21 and 300-A of the Constitution of India. 2.

It is the case of the petitioner that without following due process under Land Acquisition Act, the subject lands in this writ petition are intended to be acquired for the purpose of construction of houses under Indiramma Housing Scheme.

The respondents filed their counter stating that the land was required for construction of houses under Indiramma Housing Scheme for houseless weaker section people.

The writ petition was filed in the year 2006 and it is represented by the leaned counsel for the petitioner that as on today the petitioner is in possession of the lands and he was not dispossessed.

In view of the above submission, the writ petition is disposed of directing the respondents not to dispossess the petitioner from

the subject lands without following due process of law. No order as to costs. As sequel, the miscellaneous petitions pending if any shall stand closed.
