The petitioner herein claims to be in possession of an extent of 234.66 sq.yards consisting of structures bearing Door No.14-36-8/1/1, K.L.Rao Nagar, 50th Ward, Survey No.64/9, Pedagantyada, Visakhapatnam having acquired the same by way of an unregistered sale deed dated 8.8.2008 executed by Peetha Nagaraju S/o late Peetha China Guruvulu and others. 2.

The only grievance of the petitioner in the present writ petition is that without recourse to law, the Respondent authorities are trying to take possession of the subject property. It is further submitted that without even issuing any notice, the Respondents are high-handedly taking possession of the subject property.

On the other hand, it is submitted by the learned counsel for 2nd Respondent Corporation Sri S.Lakshminarayana Reddy and Sri K.V.Simhadri, learned Standing Counsel for 3rd respondent that the petitioner herein has no title to the subject property and the document mentioned supra does not convey any title.

Having heard the learned counsel for the petitioner, learned Standing Counsel appearing for Respondents 2 and 3 and the learned Government Pleader, this Court deems it appropriate to dispose of the writ petition, with a direction to the Respondents to issue notice to the petitioner herein before resorting to any action in respect of the subject property and to call for explanation, if any. Till the said exercise is done, Status quo as on today with regard to subject property shall be maintained. 5.

The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 18.7.2018 DA
