THE HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.842 OF 2011 ORDER:

This writ petition filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus declaring the Order dated 17.01.2011 in the proceedings No.L & O/A2/562/2010 issued by the 2nd respondent herein whereby rejecting the application submitted by the petitioner for grant of police licence to carry on the business of bar and restaurant in the name and style of M/s. Rajadhani Restaurant & Bar, at H.No.4-1-356/1, Hanmantekdi, Abids, Hyderabad as the same is illegal, arbitrary and without any authority of law and consequently direct the respondents to issue licence in favour of the petitioner.

When the matter is taken up for hearing, none appears for the petitioner. It appears that no interest is evinced by the petitioner. Hence, without going into the merits, this writ petition is disposed of leaving it open to the petitioner to make an application for redressal of his grievance within a period of four weeks from the date of receipt of this order and the respondent authorities shall pass appropriate orders on the representation submitted by the petitioner, in accordance with law, within four weeks thereafter. Till such time, interim order dated 21.01.2011 passed in W.P.M.P. No.1035 of 2011 shall continue. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
