Feeling aggrieved by non-inclusion of petitioner No.1- Union in the list of Unions prepared by respondent No.4 for verification/determination of Majority Trade Union in respondent No.5Organization, the petitioners filed this Writ Petition. At the hearing, the learned Assistant Government Pleader for Labour relied upon a judgment of this Court in Dr.Reddy's Formulation Techops of Employees Trade Union, Ranga Reddy District, Hyderabad vs. Government of Telangana and others[1] in support of his submission that as respondent No.4 is not discharging statutory functions, his decision is not amenable to the public law remedy under Article 226 of the Constitution of India.

On a perusal of the judgment cited supra, this Court finds merit in the submission of the learned Assistant Government Pleader.

In view of the same, I am not inclined to entertain this Writ Petition for adjudication on merits.

The Writ Petition is, accordingly, dismissed, however, with liberty to the petitioners to avail any other legal remedy available to them in law.

As a sequel to dismissal of the Writ Petition, WPMP.Nos.5136 & 5137 of 2016, filed by the petitioners for interim relief, are disposed of as infructuous.
