HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 24959 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the 3rd respondent in not hearing the interlocutory application in the appeal filed against the proceedings issued by the 4th respondent in RC.No.B/ 68/ 2018, dated 16.05.2018 as illegal, arbitrary and unconstitutional, and consequently direct the 3rd respondent to dispose of the main appeal in accordance with law.
2) The Government Pleader for Revenue (A.P.), who took time to get instructions, reported that the interim order in the said appeal filed against the order of the 4th respondent in RC.No.B/ 68/ 2018, will be passed within a period of four weeks. At this stage, learned counsel for the petitioner submits that he is in possession of the property and the same is to be protected.
3) Having regard to the submissions made, the present writ petition is disposed of, directing the 3rd respondent to pass orders on the stay application filed along with the appeal, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of four (04) weeks from the date of receipt of
a copy of the order. Till such time status quo obtaining as on today shall be maintained. There shall be no order as to costs.
4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
