This petition coming on for hearing, upon perusing the petition and the affidavit filed in support thereof and upon reading the Order dated 06.10.2020 in W.P.No.25023 of 2018 and upon hearing the arguments of Sri S. Rahul Reddy' counsel for the Petitioner and GP for Energy on behalf of Respondent No. 1 and of Sri R. Vinod Reddy, Standing counsel on behalf of Respondents Nos. 2 & 3, the Court made the following:
OROER ,,This application is filed under section 151 C.P.C. seeking a direction to list the matter under the caption "For Being Mentioned". The petitioner herein would contend that the time of six months stipufated in the order dated 06.'10.2020 in w.P.Nc.25023 of 2018 should be from the date of administrative approval/sanction and whereas this court has granted extension of six months time from the date of order i.e., 06.10.2020. Sri R. Vinod Reddy, learned standing counsel appearing for the TSSPDCL, vehemently opposed the application and would submit that the petitioner is taking advantage of the order dated 06.10.2020 in w.P.No.25023 ol 2018 and without completing the project, dragging the matter' He would further submit that the extension of six months time should be reckoned from I
the date of order but not from the administrative approval granted by TSSPDCL.
During the pendency of the present application, the Southern Power Oistribution Company of Telangana Limited (TSSPDCL) has issued proceedings vide SP.O.O.(Comml.)Ms.No.113/2020-21 dated 05.02.2021 granting administrative approval.
ln view of the above, the time specified in the order dated 06.10.2020 in W.P.No.25023 ol 20'18 is extended from the date of administrative sanction proceedings vide SP.O.O.(Comml.)Ms.No.11312020-21 dated 05.02.2021 issued by the TSSPDCL.
