HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.24954 of 2018 ORDER:

This writ petition is filed challenging the action of respondent-authorities in not adding the sports weightage incentive marks in the Master of Physical Education Entrance Examination for the academic year 2018-19.

Heard learned counsel for the petitioner.

Counter affidavit is filed by the 1st respondent stating that in the OUCET-2018 Information Brochure in Page No.25 (Annexure VI (a)) it is clearly mentioned that only the sports certificates, which are issued by the Issuing Authority mentioned in the brochure, will be considered for award of Sports Achievements Incentive marks. The authority from which petitioner obtained sports certificate does not fall in recognized Certificating Issuing Authority mentioned in OUCET-2018 information brochure. Hence, the petitioner's sport certificate is not considered for 25 marks of Sports Achievements Incentive marks by the committee consisting of Professors of Department of Physical Education, Osmania University while evaluating the sports certificates of the candidates. It is further submitted that the provisional list of the candidates awarded 25 marks under incentive marks for sports achievement were also kept on the university web-site on 26-06-2018 and in case of any objections, the candidates were also advised to submit representation by 30-06-2018, but

the petitioner has not raised any objection during the said period. As such his claim is not valid.

No reply affidavit is filed disputing the same. Sri Ch.Jagganadha Rao, learned Standing Counsel for the respondents reiterating the contents of counter affidavit submits that as per Annexure VI (A) of Brochure, certificate issuing authority is only National Sports Federation in respect of participation in the Senior National Championships/National Games. As such, the certificate produced by the petitioner at page 11 of the material papers goes to show that it is issued by School Games & Activity Development Foundation. Admittedly, the said authority is not the certificate issuing authority as stated supra. In view of the same, I do not see any merit in the writ petition and accordingly, the same is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
