THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.99 of 2010 JUDGMENT:

This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 02.12.2009 in A.S.No.13 of 2006 on the file of the Court of I Additional District and Sessions Judge, Machilipatnam, whereby where under the judgment and decree dated 17.10.2005 in O.S.No.351 of 2001 on the file of the Court of Principal Junior Civil Judge, Machilipatnam, dismissing the suit filed by the plaintiff for mandatory injunction, was reversed.

On 06.12.2017 this Court observed that if the appellants fail to bring the legal representatives of the sole respondent on record within two weeks from that date, the appeal stands dismissed as abated automatically.

Inspite of the conditional order passed by this Court on 06.12.2017, no LR application is filed till date. Hence, the second appeal is dismissed as abated. No costs.
