THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.13552 OF 2007 ORDER:
The relief sought for in this Writ Petition is to declare that the petitioner is entitled for absorption/appointment as a Junior Lineman under the control of the respondents with all consequential benefits. An interim order was sought to direct the respondents to dispose of the petitioner's representation dated 20.06.2001 and 16.12.2006 copies of both of which are enclosed along with the Writ Petition. Sri C. Prabhakar, Learned Counsel for the petitioner, would submit that, despite the interim order passed by this Court on 28.06.2007, the petitioner's representation has not been considered till date.
Sri R. Vinod Reddy, Learned Standing Counsel for the respondents, would submit that the petitioner had worked as a village electrical worker prior to 30.04.1991; his services were discontinued thereafter; it is only after a scheme was formulated in the year 2001, for appointment of these erstwhile village electrical workers on a regular basis as junior lineman, did the petitioner started correspondence with the respondents; and it is in such circumstances that he was not issued any order of appointment. Learned Standing Counsel would, however, express ignorance whether the petitioner's representation has been considered by the respondents.
The question whether the petitioner can claim parity with other village electrical workers, for appointment to the post of junior lineman,
can only be examined after the petitioner's representation is considered by the respondents in accordance with law. Suffice it, therefore, to dispose of the Writ Petition directing the respondents to consider the petitioner's representation dated 20.06.2001 and 16.12.2006, (copies of which are filed along with the Writ Petition) at the earliest and, in any event, not later than two months from the date of receipt of a copy of this order. The decision, which the respondents would take on these representations, shall be communicated to the petitioner within the aforesaid period of two months.
