HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.20025, 16942, 10345, 13221, 9646, 11789, 22048 OF 2016 COMMON ORDER:

The case of the petitioners is that they are assigned lands under Ex-servicemen Quota and when they tried to dispose of the same, the Sub-Registrar is not entertaining the documents presented by them for registration and also insisting for grant of No Objection Certificate (NOC) from the Revenue authorities. Aggrieved by the same, these writ petitions are filed. Learned Assistant Government Pleader for Revenue submits that some of the pattas granted in favour of the petitioners are not genuine. He also produced a copy of G.O.Ms.No.279 dated 04.07.2016 which goes to show that there is no need to obtain 'NOC' in all cases of assignment of Ex-Servicemen and Freedom Fighters in which a period of 10 years has expired.

In view of the same, the Registration Department is directed to entertain the documents presented by the petitioners or their vendees for registration, in terms of G.O.Ms.No.279 dated 04.07.2016 and register the same if the same are in order as per the provisions of Indian Stamps and Registration Act and the Rules made there under. However, it is open for the SubRegistrar to verify the genuineness of pattas granted to the petitioners.

With the above direction, these writ petitions are disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
