THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO F.C.A.MP.No.171 OF 2015 AND F.C.A.No.393 OF 2013 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal, under Section 19 of the Family Courts Act, 1984, is filed aggrieved by the order, dated 24.08.2013, passed in O.P.No.1544 of 2011 by the Additional Family Court, Hyderabad, by which, the petition filed by the appellant, under Section 12 (1) (c) and (d) of Hindu Marriage Act, 1955, to declare the marriage performed between himself and the respondent on 22.05.2011 as null and void, was dismissed.
During pendency of the appeal, appellant - husband has filed F.C.A.MP.No.393 of 2013, under Order XXIII Rule 3 read with Section 151 C.P.C., to dispose of the appeal in terms of the compromise arrived at between the parties. The appellant has also filed a Joint Memo of Compromise, which is annexed to the petition. As per the terms of compromise, learned counsel for the appellant has handed over a Demand Draft bearing No.912930, dated 10.03.2015, drawn on Syndicate Bank for an amount of Rs.2,00,000/- to the learned counsel for respondent. When the matter is called, the parties, who are present in person and who have been identified by their respective counsel,
have also requested to dispose of the appeal in terms of the Joint Memo of Compromise annexed to the petition.
In view of the reasons stated in the affidavit filed in support of F.C.A.MP.No.171 of 2015, the petition is allowed and consequently, the appeal stands disposed of in terms of the Joint Memo of Compromise annexed to the petition by annulling the marriage performed between the appellant and the respondent as prayed for. The Joint Memo of Compromise shall form part of the decree. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. No costs.
