This Writ Petition is filed praying to declare the action of the respondents in disconnecting the power supply to the cellular tower of the petitioner.

As can be seen from the order passed by this Court on 04.03.2016, the power supply to the petitioner's cellular tower was not disconnected by the Power Distribution Company - the 1st respondent, but the Municipality - the 2nd respondent, removed the fuses, as the petitioner has failed to pay the property tax. However, the Municipality cannot disconnect the power supply of the petitioner.

Having regard to the same, the Writ Petition is allowed. However, this order does not come in the way of the Municipality in taking action for recovery of arrears of property tax. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
