HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.36517 of 2014 ORDER:
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, to declare the inaction of the 4th respondent in taking action against the respondent Nos.5 and 6 pursuant to the complaint dated 01.11.2014, in spite of the endorsement made by the 3rd respondent as being illegal, arbitrary and unjust and consequently direct the 4th respondent herein to take action against the respondent Nos.5 and 6 in accordance with law pursuant to the complaint dated 01.11.2014."
Learned Government Pleader brought to the notice of this Court that pursuant to the complaint dated 01.11.2014 filed by the petitioner, a case in Crime No.540 of 2014 was registered. After completion of investigation, a final report was filed on 28.05.2015 referring the case as "lack of evidence" on the file of the III Additional Chief Metropolitan Magistrate, Hyderabad. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
Accordingly, the writ petition is closed. However, if the petitioner has got any grievance/objection against the final report, he is at liberty to file protest application as per law. No order as to costs.
