THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.3048 OF 2013 O R D E R :

Heard counsel for the petitioner and the Government Pleader for Home appearing for respondents.

2. After arguing the matter for some time, counsel for the petitioner seeks to withdraw the Writ Petition with liberty to file an appropriate application under Section 173(8) of Cr.P.C. before the Judicial First Class Magistrate, Jammalamadugu seeking further investigation into the matter, in particular, for a direction for further examination under Section 161 Cr.P.C. of the petitioner and his wife.

3. Granting liberty as sought for this Writ Petition is dismissed as withdrawn. Further, if such an application is filed, the Court below shall consider the same in accordance with law and pass appropriate orders within a period of three (03) weeks from the date of filing of the said application. There shall be no order as to costs.

4. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
