THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37007 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in interfering with the day to day affairs of the petitioner and threatening for arrest of the petitioner basing on F.I.R.No.121 of 2016 on the file of the third respondent as illegal and arbitrary, and consequently, to direct the third respondent not to arrest the petitioner in connection with the said crime including any harassment in any manner.

Heard and perused the material.

Learned counsel for the petitioner submits that the fourth respondent has filed the complaint without any valid grounds and that the third respondent has registered the said complaint being crime No.121 of 2016 and is threatening the petitioner for his arrest and as such, the fourth respondent is interfering with the civil disputes between the petitioner and the fourth respondent. Hence, he prays this Court to direct the third respondent not to arrest the petitioner.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the third respondent is not interfering with the disputes between the petitioner and the fourth respondent and that he is proceeding in accordance with law.

Considering the rival submissions made by both the counsel, the third respondent is directed to complete investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioner is directed to appear before the third respondent and execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the likesum for his future appearance for the purpose of investigation.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
