THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38352 of 2016 ORDER:

This writ petition is filed seeking to declare the inaction of the 4th respondent in not completing the investigation in Crime No.130 of 2014, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioner is that the husband of the petitioner gave a complaint before the II Additional Judicial Magistrate of First Class, at Machilipatnam, Krishna District, against the accused therein on 13.09.2014 and the matter was referred to the 5th respondent, who registered the same on 23.11.2014 as Crime No.130 of 2014 for the offences under Sections 156(3), 3(1)(v)(viii)(xv) and 3(2)(v)(vi)(vii) of the SCs & STs (POA) Act, 1989 and Sections 341, 420, 445, 452, 467, 474, 506 and 120-B IPC, but till now, the 5th respondent is not investigating the matter and in the meanwhile, the petitioner's husband died. Considering the grievance of the petitioner, the 5th respondent is directed to complete the investigation in Crime No.130 of 2014, as expeditiously as possible and file a final report, if any, either way in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
