THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9802 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 and 2 under Sections 437 and 439 Cr.P.C. seeking to grant bail to them in Crime No.82 of 2016 on the file of Muthukur Police Station, Nellore, Andhra Pradesh, registered for the offences punishable under Sections 307 and 324 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that on 23.4.2016 during night hours, the petitioners chased the injured and beat him with iron rods indiscriminately with an intention to kill him.

Learned Counsel for the petitioners submitted that the petitioners never committed any offence and they were falsely implicated in the above crime and that the injured was discharged from the hospital.

Learned Additional Public Prosecutor, while opposing this petition, submitted that the petitioners are involved in three more cases and that the investigation is in progress.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioners at this stage.
