THE HON'BLE JUSTICE G.SRI DEVI TRANSFER CRIMINAL PETITION No.112 of 2019 ORDER:

This Transfer Criminal Petition is filed by the petitioners seeking to transfer D.V.C.No.8 of 2019 from the Court of the learned Additional Judicial First Class Magistrate, Kalwakurthy, to any other competent Court at Ranga Reddy District.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for respondent No.1-State and perused the record. Though notices were served on respondent Nos.2 to 8, none appeared on their behalf.

Learned counsel for the petitioners submitted that the petitioners herein are residing at Hyderabad; that petitioner No.1 is suffering from ill-health; that petitioner No.2 is working as a Constable at Hyderabad; that petitioner No.3 is preparing for his entrance examination for M.D; and as such, it is difficult for the petitioners to attend the Court at Kalwakurthy in the aforesaid D.V.C. Learned counsel further submitted that respondent No.2 and her husband, who are residents of Kalwakurthy, are influencing the local advocates at Kalwakurthy and as such, none of the local advocates are taking up the petitioners' cause to represent them before the Court at Kalwakurthy. Therefore, the learned counsel seeks transfer of the aforesaid D.V.C. to any other Court at Ranga Reddy District. 4.

The contentions of the learned counsel for the petitioners stood unrebutted. Therefore, keeping in view the inconvenience caused to

the petitioners and that as no prejudice would be caused to the respondents herein if the aforesaid D.V.C. is transferred. 5.

Accordingly, the Transfer Criminal Petition is allowed and D.V.C.No.8 of 2019 is withdrawn from the Court of the learned Additional Judicial First Class Magistrate, Kalwakurthy and transferred to the Court of learned VI Additional Junior Civil Judgecum-VI Metropolitan Magistrate, Ranga Reddy District at L.B.Nagar. 5.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
