Bandi Ramesh, And Another, v. The State Of Ap Rep By Its Pp Hyd.,
SMT JUSTICE T. RAJANI CRIMINAL PETITION No.4907 of 2011 ORDER:
This petition is filed seeking for quash of the orders dated 15.06.2011 passed by the IX Metropolitan Magistrate, Miyapur in Crl.MP.SR No. 4756/2011 in STC No. 263/2009, in rejecting the dispense with petition for appearance of the petitioners, who are accused Nos. 1 and 2 in the Charge Sheet.
2.
When the matter was taken-up for hearing on 02.11.2017, as non appeared for the petitioners, the matter was directed to be listed under the caption "for dismissal" and thereafter on 27.11.2017, the learned counsel for the petitioners was present and reported that he has no instructions from his clients. Therefore, the matter was directed to be listed under the same caption. Accordingly, the matter was listed on 04.12.2017, but neither the counsel for the petitioners appeared nor is there any representation on their behalf. Hence, this matter is taken-up for disposal on merits. 3.
Heard the public prosecutor for the respondent. 4.
The Charge Sheet, which was filed after due investigation, against the petitioners, shows that there are specific allegations against them and their names are categorically mentioned against the offences under Sections 506 and 188 IPC.
5.
Hence, the allegations contained in the complaint, which are reflected in the charge sheet show that, prima facie, the offences are made out against the petitioners.
6.
With the above observations the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
