HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G. SHYAM PRASAD Writ Petition No.25444 of 2008 ORDER: (per V. Ramasubramanian, J.) The petitioner went before the Tribunal with a grievance that he was not granted Special Grade scale in the post of Tahsildar after completion of 8 years of service. He also had other grievance. The Tribunal allowed the application partly, but did not grant the benefit of Special Grade scale. Therefore, he has come up with the above writ petition.

2. In the counter filed by the respondents, they have conceded the fact that the petitioner joined service in the cadre of Tahsildar on 12-04-1988 and completed 8 years of service on 12-04-1996. The respondents have conceded in para-4 of the counter that the petitioner was entitled to Special Grade Scale in the category of Tahsildar from 13-04-1996. The relevant portion of para-4 of the counter, reads as follows:

"......As per the Service Register of the applicant herein, he was joined in Tahsildar cadre post i.e. Authorized Officer (Land Reforms), Vizianagaram on the A.N. of 12.04.88 AN and as such he was completed 8 years service in the post of Tahsildar by 12.04.1996, and as such he is entitled to be appointed in the special grade scale in the category of Tahsildar with effect from 13.04.1996. It is further submitted that as per the orders issued by the Hon'ble APAT in O.A.No.4915 of 2006, dt. 06.03.2007, necessary proposals for appointment of the applicant to the Special Grade/scale post have been submitted to the Chief Commissioner of Land Administration, A.P., Hyderabad vide Collector, Guntur Rc.No.494/ 2009-A4, Dt. 24.06.2009......."

VRS,J & GSP,J W.P.No.25444 of 2008 In view of the above, the writ petition is allowed, modifying the order of the Tribunal directing the respondents to grant relief to the petitioner as per para-4 of the counter affidavit and settle whatever benefits remain to be settled within a period of 12 weeks. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
