HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6591 of 2017 ORDER:
Heard the learned counsel for the petitioners/ A.2 and A.3 of Cr.No.62 of 2017 of Abdulpurmet Police Station, Rachakonda, Ranga Reddy district, registered for the offences punishable under Sections 406 and 420 IPC, and also heard the learned Public Prosecutor representing State before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and also the First Information Report.
The investigation is at nasal stage from perusal of the record, there is nothing to interdict the investigation. Having regard to the above, the Criminal Petition is disposed of without prejudice to any future defence of the petitioners. Needless to say if at all any arrest is required, the police shall follow Section 41-A of CrPC, and also as held in Arnesh Kumar Vs. State of Bihar1.
Consequently, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
