THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6352 OF 2015 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of bail in F.I.R.No.57 of 2015 on the file of the Police Station, Pitlam, Nizamabad District, registered for the offence under Section 302 IPC. Heard.
The allegation against the petitioner/accused is that the petitioner gave poison to the deceased/wife and asked her to consume it to grow-up their love and forcibly got consumed by her by putting in her mouth. Immediately, after consuming the said poison, the deceased told that she is feeling burns in her throat and tried to vomit and tried to raise hue and cry to call the neighbours, for which, the accused got angry and throttled her throat and killed the deceased. After confirming the death of the decease, the petitioner dragged the deadbody of the deceased into the bedroom and fled away.
Learned counsel for the petitioner/accused submits that the petitioner is innocent and he has not committed any offence and a false case has been foisted against the petitioner and as such, seeking grant of bail. On perusing the complaint and the order of the Court below and also in view of the fact that the investigation is not completed, this Court is not inclined to grant bail at this stage.
