THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10340 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.1 seeking bail in the event of his arrest in connection with Crime.No.226 of 2023 on the file of Dichpally Police Station, Nizamabad District, registered for the offence under Section 307 of IPC. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant lodged a complaint stating that this petitioner had stopped the de-facto complainant on the road while he was going with his wife and tried to stab him with a knife. When he raised hue and cry, other persons gathered and accordingly, the petitioner fled.

Learned senior counsel appearing for the petitioner would submit that on 11.08.2023, the wife of the petitioner had filed a complaint against the de-facto complainant alleging that de-facto complainant was following and stalking her which amounts to sexual harassment. On the basis of the said

complaint, the Dichpally Police registered a crime on 11.08.2023.

Learned Additional Public Prosecutor opposed the grant of bail on condition that offence was registered under Section 307 of IPC for attempting to commit murder.

The present incident according to the de-facto complainant happened on 01.09.2023. In the background of case being registered and also no injuries were received by the de-facto complainant, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Dichpally Police Station, Nizamabad District, on or before 27.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.1 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of four weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
