THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2767 OF 2015 ORDER:
The present criminal revision case is filed by the petitioner challenging the order, dated 14.07.2015, passed in Crl.A.No.72 of 2013 by the Court of the Principal Sessions Judge, Ongole, modifying the order passed by the Collector (CS) in Rc.CS1/6A/102/2011, dated 10.03.2013 and reducing the penalty imposed on the petitioner's vehicle from Rs.3,36,000/- to Rs.1,00,000/-.
Heard and perused the records.
Learned counsel for the petitioner submits that the petitioner has not committed any irregularities and in any event, the penalty of Rs.1,00,000/- on the petitioner's vehicle is excessive in nature and as such, prays for reduction of said penalty.
This Court, normally, is not inclined to interfere with the concurrent findings of the District Collector as well as the lower appellate Court. However, this Court feels that the said amount of Rs.1,00,000/- is excessive in nature and as such, inclined to reduce the penalty on the petitioner's vehicle.
Considering the facts and circumstances of the case, the penalty imposed on the petitioner's vehicle is reduced to Rs.50,000/- (Rupees fifty thousand only) from Rs.1,00,000/- (Rupees one lakh only) as imposed by the lower appellate Court.
With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
