THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8360 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.748 of 2022 on the file of Saroornagar Police Station, Saroornagar Division, Rachakonda, for the offences punishable under Sections 363, 364, 367, 342, 324, read with 120(B) of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

Briefly, the case of the prosecution is that the petitioner was arrested on the allegation of abducting the defacto complainant's son. For the reason that the defacto complainant was having illegal affair with Accused No.2's aunt and other ladies, this petitioner and 14 other accused have abducted the son of defacto complainant.

Since the alleged incident of abduction was subsequent to certain acts of the defacto complainant having illegal intimacy with the ladies of that area, further there are no allegations of any

assault or causing any injuries on the 'Victim', this petitioner can be granted the relief of Regular bail subject to the following conditions;

i) The petitioner/A1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of V Additional Metropolitan Magistrate Court, R.R.District at L.B.Nagar.

(ii) The petitioner/A1 shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.00 A.M. to 1.00 P.M. for a period of six weeks, for the purpose of investigation.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
