THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION Nos.11950 & 11951 of 2015 COMMON ORDER:

Since both the Criminal Petitions arise out of one and the same crime, they are heard together and being disposed of by this common order. Criminal Petition No.11950 of 2015 is filed accused Nos.5 to 7 and Criminal Petition No.11951 of 2015 is filed by accused Nos.1, 3 and 4 under Section 438 Cr.P.C seeking to grant anticipatory bail to them in Crime No.9 of 2015 of Law and Order Governorpet Police Station, Vijayawada, Krishna District, registered for the offence punishable under Sections 120-B, 464, 467, 468, 471, 474 r/w 34 IPC and Section 82 of the Registration Act.

Heard and perused the material available on record. The complainant filed a private complaint stating that he is the owner of the land of Ac.11.23 cents situated in R.S.No.183 of Jakkampudi village, Vijayawada Rural, Krishna District. He gifted Ac.2.13 cents to his wife, Ac.3.00 cents to G. Raghava Gopi Krishna; Ac.3.00 cents to G. Hemanth Raman; Ac.3.00 cents to G. Shanmukha Sai Siva Surya Narayana in the year 2007 by way of registered gift deeds and delivered possession of the same. A1 and A2, who are the southern side land owners to the complainant, sold their land showing their northern boundary owner as Vallabhaneni Lakshmi Narasamma. Subsequently, the Government issued notification proposing to acquire the land in R.S.No.

183 and award was also passed mentioning the name of the family members of the complainant as beneficiaries and the purchasers of southern side portion of R.S.No.183. While so, A1 to A4 conspired with A5 to A7 with fraudulent intention to knock away the property of the complainant and A1 styling himself as owner of the property in question executed forged and fabricated documents in favour of A5 to A7. A8 to A13 attested the said forged documents. Hence, the complainant filed a private complaint. As said complaint was referred to the police, the above crime was registered.

Considering the facts and circumstances of the case and the gravity of the offence alleged, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.
