THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.41883 of 2015 ORDER:
Learned counsel for petitioners contends that petitioners' tipper lorry bearing No.AP-29T-7682 was seized by respondents and P.O.R.No.014038 /141/2015 has been registered on 13-072015.
2. Petitioners contend that the said vehicle would be damaged since the proceedings initiated by respondents are unlikely to conclude in a reasonable time and so petitioners be allowed to have interim custody of the said vehicle.
3. The learned Government Pleader for Forests, on instructions, states that the petitioners can approach the 2nd respondent, who is authorised Officer under A.P. Forest Act, 1967 for release of the said vehicle and that the said Officer will consider release of the same on petitioners' furnishing a Bank Guarantee for the value of the vehicle as assessed by the said Officer.
4. In view of the said submission, the Writ Petition is disposed of directing the petitioners to approach the 2nd respondent for release of the above vehicle and the said Official shall consider the same in accordance with law and pass orders thereon within a period of four (04) weeks from the date of application for grant of interim custody of the said vehicle. No costs.
5. Miscellaneous petitions pending, if any in this Writ Petition, shall stand closed.
