HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.3180 OF 2012 ORDER:

Heard Ms.Nimmagadda Revathi, holding for Ms.Nimmagadda Satyanarayana, learned counsel for revision petitioners.

Defendants 6 and 7 in the suit are the revision petitioners herein. Plaintiff/ Respondent No.1 herein filed the suit O.S.No.141 of 2003 for specific performance of contract of sale. Respondent No.1 filed I.A.No.762 of 2007 seeking impleadment of respondent No.8 herein as defendant No.8 in the suit. The learned Judge, through the order impugned in the revision, allowed the said application. Hence, the present revision.

Though Ms.Revathi made strong effort to convince this Court on the alleged illegality committed by the trial Court in allowing the application thereby bringing on record one Uppalapati Sudhakar Babu as 8th defendant, this Court after perusing the reasons recorded by the learned trial Judge and also that it is proper and necessary to ensure the presence of the legal representatives of deceased/ 1st respondent, the application is allowed with right reasons.

I do not see a ground to interfere with the order under revision.

The revision is, accordingly, dismissed. The learned trial Judge is directed to dispose of the suit as expeditiously as possible

preferably within eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous petitions, if any, stand closed. ____________ S.V.BHATT, J 05th September, 2018 Lrkm
